Notice to the Bankruptcy Bar Regarding Fees on Receipt

The Executive Office of the United States Trustee (EOUST) has notified chapter 13 trustees nationwide of its new policy pertaining to the timing of percentage fees collected by chapter 13 trustees.
Chapter 13 trustees shall take and account for their percentage fee at the time of receipt, for both confirmed and unconfirmed cases, pursuant to 28 U.S.C. §586(e)(2). Previously fees were collected at the time of disbursement. Implementation of this change will vary depending on the software servicer utilized by each trustee. In my office, the anticipated effective date to implement this change is December 1, 2014.
